NGO Aktiv invites you to the presentation of the report titled “Property rights between factual circumstances and judicial protection – acquisitive prescription and the formalization of informal contracts in Kosovo,” which will be held on May 26, 2026, starting at 10:30, at the Civic Energy Center (CEC) in North Mitrovica.
The report addresses one of the key challenges of Kosovo’s legal system – the acquisition and protection of property rights in the context of longstanding informal real estate transactions and incomplete records in public registries. Special attention is given to the relationship between the factual situation on the ground and formal legal mechanisms for the protection of property rights, as well as the consequences such circumstances have for citizens’ legal security and property protection.
The analysis examines two parallel mechanisms existing within Kosovo’s legal framework: the traditional institute of adverse possession, implemented through court proceedings, and the administrative model for the formalization of informal contracts, introduced with the aim of resolving inherited property-related legal relations.
Through a comparative analysis of judicial practice and administrative procedures, the authors assess the advantages, limitations, and level of legal protection both models provide to citizens, with particular emphasis on the balance between procedural efficiency and legal certainty.
The event will gather legal experts, representatives of civil society, and international organizations. Following the presentation, an open discussion will be organized on the practical and legal implications of new mechanisms for the formalization of property-related legal relations in Kosovo.
